Your Rights

Review and Copy Records

  • We will usually supply a copy or a summary within 30 days. Fees may be applicable.’

Corrections to Records

  • You can request corrections to inaccurate or incomplete PHI. We may decline the request but will communicate our reasons in writing within 60 days.

Confidential Correspondence

  • You can specify how we should contact you (e.g., via home or work phone) or direct us to use a different mailing address.

Limitation on Use and Disclosure

  • You may request that we limit the use or disclosure of specific PHI. While we are not obligated to agree, we will consider your request thoughtfully.
  • If you fully pay out-of-pocket for a service, you can request that the corresponding PHI not be disclosed to your health insurance provider.

Record of Disclosures

  • You can ask for an accounting of the occasions on which we have disclosed your PHI over the past six years. Certain exclusions apply.
  • The first list each year is complimentary; subsequent lists may incur a fee.

  • You can request a physical copy of this notice at any time, irrespective of your prior agreement to receive it digitally.

Authorized Representatives

  • If someone holds medical power of attorney for you or is your legal guardian, they can act on your behalf regarding your PHI.

Lodge a Complaint

  • To lodge a complaint, reach out to our Compliance Department at compliancereporting@apreciouselder.com.
  • You can also file a complaint with the U.S. Department of Health and Human Services without fearing retaliation.

You have the right to request to receive confidential communications of protected health information from us by alternative means or at alternative locations.

Your Choices

Controlling Information Sharing

  • You hold the right to guide us on sharing your PHI with family, friends, or others involved in your healthcare or its payment.
  • You can also control how we share information during disaster relief efforts or in hospital directories.

Special Restrictions

  • Your written permission is required for us to use or disclose your PHI for marketing, selling your information, or for sharing most psychotherapy notes.
  • You may opt out of any fundraising communications from us.

Our Typical Uses and Disclosures of PHI

  • Our primary uses or disclosures of your PHI are for treatment, billing, and healthcare operations.
  • We may also disclose your PHI for public wellbeing, research, legal requirements, and other activities benefiting the public, but only as permitted by law.

This notice is subject to updates, and any changes will be applicable to all PHI under our care. The revised notice will be accessible upon request, on our website, and a physical copy will be mailed to you if you ask for it.
